Keen Planning is proud to celebrate our part in securing a planning permit for the Sikh Sewaks’ new place of worship in Pakenham in a rural setting, close to the Urban Growth Boundary. Known for their community work within and beyond the Cardinia Shire community, the Sikh Sewaks have been at the forefront of charitable efforts particularly during times of crisis, including the 2009 bushfires and the COVID pandemic.
The proposed development includes a purpose-built worship building which is built into the sloping terrain, and the retention of the balance of the land is to be retained as agricultural land and remnant vegetation surrounding a stream which runs through the west part of the site.
Keen Planning managed the application with close communication with the Council Planning Department and obtained their support however in response to objections, the proposal was refused at a Council meeting.
The VCAT appeal, which was undertaken with Best Hooper Lawyers, highlighted the small proportion of the site devoted to the place of worship, the retention of the rural/agricultural values of the land, the appropriate location of the site near the Urban Growth Boundary and the site’s suitability for horse riding and agricultural activities that form part of the spiritual practice of the Sikh religion. The Tribunal agreed and directed Council to issue a planning permit.
