53 lot industrial subdivision

Having obtained a planning permit that allowed the development of a 53 unit storage facility, we were surprised when our client required our further assistance for the subdivision of the facility.

Council was concerned that the subdivision into individual lots would transform the nature of the development and make it more likely for individual owners to use their premises for other activities and stay longer on site.

In response we provided a detailed submission including examples/analyses of other similar developments and a range of other details supporting the fact that the subdivision was not changing the nature of the approved use/development. A legal opinion was also sought. A planning permit was then issued and construction is now completed.
